Definition and nature of personal data<\/strong>
Capitalized terms and expressions used in this policy have the meaning given to them in the Dare in Paris Terms of sale.<\/p>

When you use the website www.dareinparis.fr (hereinafter the \u201cSite\u201d), we may ask you to provide personal data about yourself so that you can use the services we offer (hereinafter the \u201cServices\u201d).<\/p>

In this policy, the term \u201cpersonal data\u201d means any data that makes it possible to identify an individual, in particular your last name, first names, username, photograph, postal and email addresses, telephone numbers, date of birth, data relating to your transactions on the Site, details of your purchases and subscriptions, bank card numbers, and any other information you choose to provide about yourself.<\/p>

Purpose of this policy<\/strong>
The purpose of this policy is to inform you of the means we use to collect your personal data, in strict compliance with your rights.<\/p>

In collecting and managing your personal data, we comply with French law no. 78-17 of January 6, 1978 on information technology, data files and civil liberties, as currently in force (hereinafter the \u201cFrench Data Protection Act\u201d), and with Regulation (EU) 2016\/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the \u201cGDPR\u201d).<\/p>

Identity of the data controller<\/strong>
The controller responsible for collecting your personal data is Dare in Paris, a French simplified joint-stock company (SAS) registered with the Paris Trade and Companies Register under number 890 249 147, whose registered office is at 40 rue du Rendez-Vous, 75012 Paris, France (hereinafter \u201cWe\u201d).<\/p>

Collection of personal data<\/strong>
The legal bases for collecting your personal data are as follows\u00a0:<\/p>

Our legitimate interest, when you voluntarily provide personal data during your visit to our Site, the data then being collected so that we can better answer your requests for information about our Services.
Your consent, for the cookies described in our Cookie policy<\/a> in the appendix.
This collection is necessary to perform the contract entered into when you use our Services on our Site.
Finally, the processing of your data may be necessary to comply with a legal obligation to which we are subject.
Your personal data is collected for one or more of the following purposes\u00a0:<\/p>

When we collect your personal data, we tell you whether certain data must be provided or is optional. Mandatory data is necessary for the Services to work. You are entirely free to provide optional data or not. We also tell you the possible consequences of not providing it.<\/p>

Recipients of the data collected<\/strong>
The following will have access to your personal data\u00a0:<\/p>

the staff of our company and the departments in charge of audits (in particular our chartered accountant)\u00a0;
our subcontractors\u00a0: delivery service providers, hosting provider, CRM tool, audience measurement and analytics provider.
Public bodies, exclusively to meet our legal obligations, officers of the court, ministerial officers and debt collection bodies may also receive your personal data.<\/p>

Transfer of personal data<\/strong>
Your personal data will not be sold, rented or exchanged for the benefit of third parties.<\/p>

Retention period of personal data<\/strong>
For data relating to the management of customers and prospects\u00a0:
Your personal data is kept for the time strictly necessary to manage our business relationship with you.<\/p>

For any marketing operations aimed at you, your data may be kept for 3 (three) years from the end of the business relationship.<\/p>

Data used to establish proof of a right or a contract, which must be kept to comply with a legal obligation, will be kept for the period required by applicable law.<\/p>

Personal data relating to a prospect who is not a customer may be kept for 3 (three) years from its collection or from the last contact initiated by the prospect.<\/p>

At the end of this 3 (three) year period, we may contact you again to ask whether you wish to keep receiving marketing communications.<\/p>

For identity documents\u00a0:
If you exercise your right of access, rectification or objection, data relating to identity documents will be kept only for the time needed to verify your identity.<\/p>

For bank card data\u00a0:
Financial transactions relating to the payment of purchases and fees on the Site are entrusted to a payment service provider that ensures they run smoothly and securely.<\/p>

For the purposes of the services, this payment service provider may receive your personal data relating to your bank card numbers, which it collects and keeps in our name and on our behalf.<\/p>

We do not have access to this data.<\/p>

To allow you to make regular purchases or pay the related fees on the Site, your bank card data is kept for as long as you are registered on the Site, within the limit of your card\u2019s validity period and at least until you make your last transaction.<\/p>

By ticking the box provided for this purpose on the Site, you give us your express consent to this retention.<\/p>

Data relating to the card security code (CVV2) printed on your bank card is not stored.<\/p>

If you refuse to have your personal data relating to your bank card numbers kept under the conditions set out above, we will not keep this data beyond the time needed to complete the transaction.<\/p>

In any event, this data may be kept in intermediate archives, as evidence in the event of a dispute over the transaction, for the period set by Article L 133-24 of the French Monetary and Financial Code, namely 13 (thirteen) months from the debit date. This period may be extended to 15 (fifteen) months to allow for the use of deferred debit cards.<\/p>

For data relating to transactions on the Site\u00a0:
Data relating to your transactions and purchases on the Site, except bank card data, is kept for 5 (five) years to comply with our legal obligations.<\/p>

For invoices\u00a0:
Invoices are kept for 10 (ten) years to comply with our accounting obligations, in accordance with Article L. 123-22 of the French Commercial Code.<\/p>

For the management of lists of people who object to receiving marketing\u00a0:
The information needed to take your right to object into account is kept for at least 3 (three) years from the date you exercised that right.<\/p>

Security<\/strong>
We take all appropriate precautions and organizational and technical measures to preserve the security, integrity and confidentiality of your personal data, and in particular to prevent it from being altered, damaged or accessed by unauthorized third parties. We also use secure payment systems that are state of the art and comply with applicable regulations.<\/p>

Hosting<\/strong>
Your data is kept and stored, for its entire retention period, on the servers of KINSTA, located in Belgium, in the European Union.<\/p>

Some of our service providers are based in the United States\u00a0: Google (Google Analytics audience measurement), Microsoft (Clarity audience measurement) and Klaviyo (sending our emails and newsletters). The data they receive may be transferred there. These transfers are governed by the EU-US Data Privacy Framework, recognized by the European Commission on July 10, 2023, under which these companies are certified.<\/p>

Access, rectification and erasure of your personal data<\/strong>

You have a right to the portability of the personal data you have provided to us, meaning the data you have actively and knowingly declared when accessing and using the Services, as well as the data generated by your activity when using the Services. Please note that this right does not cover data collected and processed on a legal basis other than consent or the performance of the contract between us.<\/p>
